Tobacco-Free Nicotine Products
If you sell tobacco-free nicotine products such as nicotine pouches, you must notify the municipality before starting sales. Together with the notification you must submit a self-monitoring program describing your routines for age verification, marketing, and product labeling.
The products may not be sold to persons under 18, and the point of sale must display clear signage about the age limit. The municipality, the Police Authority, and the Public Health Agency (Folkhälsomyndigheten) exercise supervision and may conduct test purchases. Municipalities charge annual supervision fees. Marketing restrictions similar to those for tobacco products apply to tobacco-free nicotine products.
Requirements
- Age verification: May not be sold to persons under 18 years, ID check recommended if customer appears to be under 25 years
- Visible information: Clear notice about 18-year age limit must be displayed at point of sale
- Labeling: Products must have correct ingredient declaration in Swedish and meet health warning requirements
- Self-monitoring: A self-monitoring program adapted to the business must exist and be followed
Procedure
- Notification: Sent to the municipality where the point of sale is located, or to the Public Health Agency if the company lacks registered office or permanent establishment in Sweden
- Self-monitoring program: Must be attached to notification and contain routines for age verification, marketing and labeling
- Supervision fee: The municipality may charge a fee for supervision
- Supervision: The municipality, Police Authority and Public Health Agency can inspect the business and conduct test purchases at any time
