Environmental Exemption

A provincial environmental exemption is a waiver from certain environmental rules laid down in the provincial environmental regulation (provinciale milieuverordening). As a business operator, you must in principle comply with all environmental rules for your business activities. In specific cases, the province may grant an exemption from these rules.

The exemption is granted by the province of Limburg and relates to activities that pollute the environment, such as noise, energy, waste, air and soil use. For many other environmental activities you need an environmental permit or must submit a notification.

Requirements

  • Scope: The activity must fall under the provincial environmental regulation of Limburg
  • Justification: You must provide a reasoned explanation why an exemption is necessary
  • Alternative measures: You must demonstrate what measures you are taking to limit environmental impacts
  • Location: The activity must take place within the province of Limburg

Procedure

  • Application: Submit an application to the province of Limburg with justification and description of the activity
  • Assessment: The province assesses whether an exemption can be granted without unacceptable environmental impacts
  • Conditions: Conditions may be attached to the exemption
  • Decision: You will receive a decision on the exemption
  • Objection and appeal: Interested parties may lodge objections and appeals against the decision
