Code of Conduct Habitats Directive
The code of conduct for the Habitats Directive (gedragscode Habitatrichtlijn) is an approved instrument for working with or near protected animal species covered by the European Habitats Directive. These species have strict protection and disturbance is prohibited in principle.
By working according to a code of conduct approved by the minister, certain activities can be carried out without requiring a separate exemption. The code contains specific measures to prevent the favorable conservation status of the species from being affected and to limit negative effects as much as possible.
Requirements
- Approved code: Use a code of conduct approved by the Minister of Agriculture, Nature and Food Quality
- Species: Applicable to species covered by the European Habitats Directive
- Measures: Strict compliance with all prescribed measures to protect the species
- Expertise: Ecological supervision or specific expertise may be required
- Documentation: Maintain registration of work performed and measures taken
Procedure
- Select code: Choose the correct approved code of conduct for your activity and sector
- Preparation: Possibly conduct preliminary research into the presence of protected species
- Implementation: Carry out the activity according to the code of conduct requirements
- Monitoring: Check during and after the work that no negative effects occur
- No exemption: With correct application, no separate Nature Conservation Act exemption is needed
