Environmental Permit for Advertising Activity
If you want to place advertising displays, such as billboards, banners, illuminated signs or other forms of outdoor advertising, you often need an environmental permit (omgevingsvergunning) for the activity 'advertising'. This permit regulates where and how advertising may be placed to protect public space and the streetscape.
The permit is intended to prevent proliferation of advertising displays and to ensure that advertising fits within the character of the environment. Municipalities set their own rules regarding size, location, lighting intensity and duration of billboards.
Requirements
- Type of advertising: Environmental permit may be required for permanent and temporary advertising displays, depending on size and location.
- Application documents: Site plan showing location of advertising, dimensions, material use, any lighting, and photo impression or visualization.
- Stakeholders: Owner or user of the property or building, or authorized representative on their behalf.
Procedure
- Submit application: Online via the Omgevingsloket (Environment Portal), using DigiD (individuals) or eHerkenning (businesses).
- Competent authority: The municipality where the advertising is placed is the competent authority.
- Processing period: According to statutory periods of the Omgevingswet (Environment and Planning Act).
- Assessment: The application is assessed against the environmental plan (omgevingsplan), aesthetic criteria and any other local advertising rules.
Restrictions
- Location: Advertising is often not permitted in residential areas, protected cityscapes or near monuments.
- Size and lighting: Municipalities may impose requirements on maximum dimensions, colors and light intensity to prevent light pollution.
- Refusal: The permit can be refused if the advertising disfigures the streetscape, endangers traffic safety, or conflicts with aesthetic requirements.
