Environmental Permit for Deviation from Environmental Plan
If your business plans do not fit within the rules of the local environmental plan (omgevingsplan), you can apply for an environmental permit for deviation (omgevingsvergunning afwijking). This is common when you want to use a building for a purpose not foreseen in the plan, or when your construction plans exceed what is allowed.
You submit your application through the Omgevingsloket (Environmental Portal). The municipality assesses whether the deviation is acceptable by considering how your plans fit within the spatial development of the area. Processing times vary depending on the scope of the deviation.
Requirements
- Application form: Complete application form via the Omgevingsloket
- Construction drawings: Site plans and construction drawings of the plan
- Justification: Explanation of why deviation from the environmental plan is necessary
- Spatial justification: Description of the effects on the environment
