License for Security and Investigation Agency

A license for a security and investigation agency is mandatory if you want to offer professional security or investigation services in the Netherlands. Under the Private Security Organizations and Detective Agencies Act (Wpbr), it is prohibited to operate a commercial security or investigation business without this license.

The license is granted by the Minister of Justice and Security after a thorough assessment of the applicant. You must demonstrate reliability, professional competence, and sound business operations. All employees performing security or investigation work also need individual permission (toestemming). The license must be renewed periodically, and the Justis screening authority conducts background checks on the business and its directors.

Requirements

  • Reliability: The applicant and managers must be reliable and may not have a relevant criminal record.
  • Professional competence: The manager must have demonstrable knowledge and experience in the security or investigation industry.
  • Business operations: The organization must have a sound business structure and sufficient financial resources.
  • Certificate of Conduct: A Certificate of Conduct (VOG) is required for all involved persons.

Procedure

  • Submit application: The application is submitted digitally to the Ministry of Justice and Security via the application portal.
  • Screening: An extensive screening takes place of the applicant and all involved persons.
  • Assessment: The minister assesses the application based on laws and regulations.
  • Decision: The decision is made within 8 weeks, unless the period is extended.
  • Fees: Fees are due for the application and granting of the license.

Restrictions

  • Notification obligation: Changes in business operations or personnel must be reported.
  • Supervision: The organization is supervised by the Inspectorate of Justice and Security.
  • Revocation: The license can be revoked in case of violation of the law or conditions.
  • Validity: The license is valid indefinitely but may be reviewed periodically.
