Seed Shop – Garden Center

If you run a seed shop or garden center (graineterie-jardinerie) in France, your activity becomes regulated as soon as you sell plant protection products or treated seeds. To sell these products, you need a personal Certiphyto certificate and your business must hold an agrément (approval) as a distributor, issued by the DRAAF.

No specific diploma is required for general plant and garden supply sales. However, if you stock phytopharmaceutical products, your responsible and sales staff must each hold a valid Certiphyto. You can only sell products bearing the mention "usage autorisé dans les jardins" to non-professional customers. A garden center may also include a pet shop activity, subject to separate regulations.

Requirements

  • Certiphyto certificate: Individual certificate for "marketing and sale of plant protection products" (category "Mise en vente, vente" as main activity, or "Utilisation" as ancillary activity)
  • Distributor approval: Approval to operate as a distributor of plant protection products
  • Professional liability insurance: Professional liability insurance certificate
  • Company certification: Certificate issued by a third-party organization attesting compliance with public health and environmental protection conditions
  • Financial guarantee: Financial guarantee certificate in case of fund collection
  • SEMAE registration: Registration with the SEMAE (Société nationale interprofessionnelle des semences et des plants) to market seeds and plants

Procedure

  • Certiphyto certificate application: Create account on service-public.fr, submit training certificate or diploma to DRAAF, issued within 2 months, valid 5 years renewable
  • Approval application: Submit approval application form and supporting documents to regional prefect, provisional approval 6 months then final approval, 2-month silence equals rejection
  • Micro-distributor approval: Submit to DRAAF insurance certificate, employee Certiphyto certificates, document attesting micro-enterprise status, list of business sites
  • LPS declaration (EU/EEA nationals): Declaration to DRAAF with individual certificate from member state, renewable annually and upon change of situation
  • RMA or RCS registration: Depending on nature of activity
  • SEMAE registration: Submit completed questionnaire to SEMAE, registration certificate issued

Restrictions

  • Sales to non-professionals: Only products bearing the mention "authorized for use in gardens" may be sold to non-professional individuals
  • Sales to professionals: Mandatory verification of holding an individual Certiphyto certificate (categories "Decision-maker in works and services", "Decision-maker in agricultural works" or "Local authority applicator")
  • Information obligation: Product separation with explicit signage, provision of information on use and health and environmental risks, safety instructions
  • Activity register: Maintenance of chronological sales register with annual report transmitted to water agency before April 1st
  • Official catalogs: Only seeds and plants listed in the official catalog of cultivated plant species and varieties may be marketed (French and European catalogs available on SEMAE website)
